Terms of Use

1. Acceptance of Terms

By accessing or using MailCraft ("the Application"), you agree to be bound by these Terms of Use in full. If you do not agree, you must not use the Application. Continued use following any update to these terms constitutes acceptance of the revised terms.

2. Authorised Use Only

MailCraft is provided exclusively for lawful, permission-based email marketing activities. You may only use the Application to send commercial communications to individuals where you hold a valid lawful basis under applicable law — including prior express consent or a validly established soft opt-in (existing customers who were given a clear opportunity to opt out at the point of collection and did not do so), including but not limited to:

Important: Any breach of marketing law, data protection law, or anti-spam regulation arising from your use of this Application is your sole legal liability. The Application owner accepts no responsibility whatsoever for your sending activity or its consequences.

The whole and sole architecture, operational scripts, and codebase of this Application are strictly proprietary to Rujuta Sawant. Unauthorised copying, decompiling, altering, transferring, reselling, or redistributing of this source code or architecture is strictly prohibited. All rights reserved.

6. No Warranty

The Application is provided "as is" without warranty of any kind, express or implied. The Application owner does not warrant that the service will be uninterrupted, error-free, or fit for any particular purpose. You use the Application entirely at your own risk.

7. Data Processing Agreement

By accepting these Terms, the Client also accepts the Data Processing Agreement ("DPA"), which is incorporated into and forms part of these Terms. The DPA governs all processing of personal data by the Provider on behalf of the Client and sets out the obligations of each party under UK GDPR Article 28.

7A. Indemnity

The Client shall indemnify and hold harmless the Provider against all claims, demands, losses, liabilities, regulatory fines, penalties, and reasonable legal costs and expenses arising out of or in connection with:

except to the extent that the claim arises from the Provider's own breach of its obligations under the Data Processing Agreement or the Provider's negligence.

8. Limitation of Liability

Subject to the paragraph below, and to the fullest extent permitted by law, the Provider shall not be liable to the Client for any indirect or consequential loss, or for any regulatory fines, penalties, or legal costs the Client incurs as a result of the Client's own email-sending activity or breach of these Terms.

Nothing in these Terms excludes or limits the Provider's liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable law; or (d) the Provider's own breach of its obligations as a data processor under the Data Processing Agreement, including its security obligations under Article 32 UK GDPR.

10. Third-Party Services

MailCraft uses Resend (resend.com) as its email delivery provider. By using MailCraft, you also agree to Resend's Terms of Service and Acceptable Use Policy. The Application owner is not responsible for the availability, performance, or policies of Resend or any other third-party service.

11. Changes to These Terms

These terms may be updated at any time. The current version and effective date are shown at the top of this page. Your continued use of the Application after any update constitutes acceptance.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Summary: Use MailCraft lawfully. Only email people who have consented. Honour all unsubscribes. If you break the law, that is your responsibility, not ours.
